Unless otherwise stated, original content created for or owned by The Hair Boutique by Felicity is protected by applicable intellectual-property law.

Such content may include:

  • product descriptions;
  • promotional wording;
  • business photographs;
  • product photographs;
  • videos;
  • graphics;

  • create a misleadingly similar website or domain name; or

Suspected impersonation, fraud, or misleading commercial conduct may be reported to the relevant platform, domain registrar, payment provider, or lawful authority.

9. Permitted Personal Use

You may access and use the website for lawful personal purposes, including:

14. Artificial Intelligence Use

This section does not prohibit a use that Ghanaian law expressly permits and that cannot lawfully be restricted by contract.

15. Product Photographs and Videos

Our product photographs and videos may contain protected creative expression and confidential commercial presentation.

Purchasing a product shown in an image does not transfer ownership of the photograph or video.

Customers may take and own their own photographs of purchased products, subject to the rights of any identifiable persons or protected third-party content appearing in them.

A reseller must obtain permission before using our original photographs to advertise products.

16. Customer Images and Personal Likeness

A customer retains rights they lawfully hold in their own image, photograph, video, or other submitted content.

We will seek appropriate permission before using an identifiable customer image for advertising or promotional purposes.

Permission should be explained, where relevant:

  • duration;
  • editing;
  • whether compensation is provided; and
  • how consent may be withdrawn for future use.

Copyright permission and data-protection consent may be separate matters.

Withdrawal will not necessarily make lawful use completed before withdrawal unlawful or require recall of material already lawfully printed and distributed.

When a customer submits a review, photograph, video, or testimonial, the customer confirms that:

  • the customer owns it or has permission to submit it;

  • It is not defamatory or deceptive;
  • it does not contain unlawful material; and
  • Any identifiable person has given the required permission.

Unless otherwise agreed, the customer grants us a limited, non-exclusive, royalty-free license to:

  • store the content;
  • display it on the website;
  • reproduce it for the purpose for which it was submitted;
  • format or resize it;
  • correct spelling;
  • moderate unlawful material; and
  • Use it to respond to the customer.

We will obtain appropriate additional permission before using identifiable customer content in unrelated advertising.

The customer retains ownership of the submitted content unless rights are expressly assigned in writing.

18. Moral Rights and Attribution

Where applicable under Ghana’s Copyright Act, authors may have moral rights relating to:

A general hairstyle, idea, technique, or concept may not automatically qualify for copyright or industrial design protection merely because it appears on the website.

This Notice claims protection only to the extent recognized by law.

25. Ideas, Methods, and Facts

Copyright generally protects original expression rather than every:

  • idea;
  • concept;
  • fact;
  • procedure;
  • method;
  • system;
  • hair technique; or
  • general style.

No claim is made over material that Ghanaian law places outside copyright protection.

However, the particular photographs, videos, wording, illustrations, or training presentations used to explain an idea or method may be protected.

26. Confidential Information

Information disclosed privately for a custom order, supplier relationship, business arrangement, or training program may be subject to confidentiality obligations.

You must not disclose or misuse confidential information received through a private relationship merely because it is not protected by copyright.

Confidentiality, privacy, and intellectual property rights are separate legal protections.

29. Counter-Notice

A person whose content was removed may submit a counter-notice explaining why:

  • The person owns the content;

  • the use is licensed;
  • A legal exception applies;
  • the wrong material was identified; or
  • removal resulted from a mistake.

The counter-notice should include supporting evidence.

We may restore content where appropriate unless a court order, settlement, legal obligation, or continuing credible dispute prevents restoration.

30. False or Misleading Claims

A person must not knowingly submit a false infringement notice, false counter-notice, or fabricated ownership document.

A false claim may expose the sender to legal consequences, including liability for loss caused to another person.

A good-faith complaint will not be rejected merely because the legal issue is disputed.

31. Reporting Misuse of Our Content

  • reporting suspected criminal conduct to the appropriate authority.

The remedy pursued will depend on the evidence, seriousness, and applicable Ghanaian law.

33. Protection Against Unfair Competition

Ghana’s Protection Against Unfair Competition Act, 2000 (Act 589), prohibits conduct including:

  • causing confusion with another enterprise;
  • damaging another person’s goodwill or reputation;
  • misleading the public; and
  • discrediting another enterprise or its activities.

No person may use our business identity, content, or reputation to mislead customers about:

  • origin;
  • affiliation;
  • ownership;
  • sponsorship;
  • quality;
  • availability; or
  • payment destination.

We will also respect the rights and goodwill of other businesses.

34. No Transfer of Rights

Accessing the website, creating an account, placing an order, or purchasing a product does not transfer ownership of any website intellectual property.

A license or assignment of intellectual property rights must be expressly granted by an authorized person and, where required, recorded in writing.

Silence or failure to immediately object to misuse does not constitute permission.

Where appropriate, the parties may agree to:

  • another method of alternative dispute resolution

under Ghana’s Alternative Dispute Resolution Act, 2010 (Act 798).

Nothing prevents a rights holder from seeking urgent injunctive relief or another remedy from a court of competent jurisdiction.

38. Governing Law

This Notice is governed by the laws of the Republic of Ghana.

Any dispute relating to website content, branding, or intellectual property will be handled under applicable Ghanaian law and the jurisdiction of Ghana’s competent courts or authorities.

39. Changes to This Notice

We may update this Notice when:

  • website content changes;
  • branding changes;
  • New content types are introduced;
  • licensing arrangements change;
  • Ghanaian law changes; or
  • Regulatory or judicial guidance is issued.

The revised Notice will be published with an updated “last updated” date.
