1. About These Terms
These Promotions and Discount Terms (“Promotion Terms”) apply to sales, discount codes, coupons, vouchers, bundles, gifts with purchase, loyalty rewards, referral offers, competitions, giveaways, and other promotional offers made by The Hair Boutique by Felicity (“we,” “us,” or “our”) through our website, social media pages, WhatsApp, telephone, or physical store.
These promotion terms supplement our terms and conditions, payment policy, shipping and delivery policy, returns, exchanges and refund policy, order cancellation policy, custom-order policy, and privacy policy. The specific conditions displayed with a promotion also form part of these promotion terms. If the specific conditions conflict with these general promotion terms, the specific conditions will apply to that promotion, except where doing so would remove a right that cannot lawfully be excluded.
By participating in or redeeming a promotion, you agree to these Promotion Terms. Nothing in them limits any right or remedy available under the laws of Ghana.

3. Legal framework
These promotion terms are governed by the laws of the Republic of Ghana. Relevant laws may include the Electronic Transactions Act, 2008 (Act 772), as amended; the Protection Against Unfair Competition Act, 2000 (Act 589); the Data Protection Act, 2012 (Act 843); the Payment Systems and Services Act, 2019 (Act 987); the Value Added Tax Act, 2025 (Act 1151) and applicable tax legislation; the Gaming Act, 2006 (Act 721), as amended, where a prize promotion falls within its scope; and other applicable contract, advertising, intellectual-property, criminal and consumer-protection rules.
We intend every promotion to be clear, honest, and capable of verification. A promotion will not be interpreted to permit misleading advertising, hidden compulsory charges, unlawful discrimination, or the removal of a customer’s mandatory legal rights.
4. Promotion-specific information
Before or at the time a promotion is advertised, we will state the material conditions reasonably required for a customer to make an informed decision. Depending on the offer, these may include:
- the promotion name and benefit;
- the start and end date and time, using Ghana Mean Time unless otherwise stated;
- eligible products, services, customers, or locations;
- minimum or maximum order value;
- stock or redemption limits;
- excluded products, including custom-made or already-discounted items;
- the method of entry or redemption;
- delivery charges and any other compulsory costs;
- whether a code may be used once or more than once;
- whether the promotion may be combined with another offer; and
- special conditions for gifts, referrals, competitions, or giveaways.
Any material limitation will be displayed reasonably prominently and will not be concealed in a way likely to mislead customers.
5. Eligibility
Unless a promotion states otherwise, it is available only to persons aged 18 years or older who can enter a legally binding transaction. A minor may participate only through a parent or legal guardian where lawful.
A promotion may be limited to Ghana, a delivery area, new customers, existing customers, newsletter subscribers or another objectively described group. Employees, contractors, and immediate family members of The Hair Boutique by Felicity may be excluded from prize promotions where stated.
We may require reasonable proof of age, identity, location, eligibility, purchase, or account ownership. We will process that information in accordance with our Privacy Policy and Ghana’s Data Protection Act, 2012 (Act 843).
6. Promotion periods and availability
A promotion begins and ends at the date and time stated in its advertisement. Entries, orders or code attempts received outside that period are not eligible unless we expressly extend the offer.
All product promotions are subject to availability. If a promoted item becomes unavailable after payment, we will notify the customer promptly and offer an appropriate lawful remedy, which may include a replacement accepted by the customer, store credit accepted by the customer, or a refund. Where Act 772 requires a refund for unavailable goods or services, we will process it within the applicable statutory period.
Adding an item to a basket does not reserve stock. An order is accepted only in accordance with our Terms and Conditions.
7. Discount codes and coupons
Unless the offer states otherwise:
- Only one promotion code may be used per order;
- A code must be entered or presented before the order is completed
- A code cannot be applied retrospectively to an earlier order;
- a code has no cash value and cannot be sold, transferred, exchanged for cash, or used to buy another voucher;
- A code applies only to eligible items and does not reduce delivery charges, taxes, or other excluded fees;
- A percentage discount is calculated on the eligible product subtotal after excluded items and prior credits are removed;
- A fixed-value discount cannot reduce the payable product subtotal below zero; and
- unused value is forfeited unless the specific offer or applicable law requires otherwise.
A customer must check that the discount has been applied before authorizing payment. If a valid code fails because of a technical error, the customer should contact us before completing the order. We will investigate and provide an appropriate remedy where the customer met the published conditions.
8. Sale prices and price comparisons
Promotional prices will be shown in Ghana cedis (GHS) unless another currency is clearly stated. Any comparison, such as “was/now,” a percentage saving, or a reference price, will be based on a genuine price and will not be presented in a materially misleading manner.
The full amount payable, including applicable taxes, delivery charges, and other compulsory costs, will be disclosed at or before checkout as required by law. If we are registered or required to be registered for VAT, applicable VAT and statutory levies will be charged and invoiced in accordance with Ghana Revenue Authority requirements.
An obvious pricing or technical error does not require us to supply a product at an unintended price where enforcing that price would be unlawful or unreasonable. If such an error affects an order, we will notify the customer promptly, cancel the affected item or order where necessary, and refund any amount paid for it. We will not use this clause to avoid a genuine advertised offer or mislead customers about availability or price.
9. Minimum spend, bundles, and gifts with purchase
Where a minimum spend applies, it is calculated using eligible products after other discounts, returns, and cancellations and excludes delivery fees, taxes, vouchers, and excluded items unless the promotion states otherwise.
Bundle prices apply only when all stated bundle items are purchased together. If a customer lawfully returns part of a bundle, the refund may be recalculated to reflect the price that would have applied to the retained items, provided that this was disclosed and does not reduce a mandatory legal remedy.
A free gift is subject to availability and has no cash alternative unless stated. If the qualifying order is cancelled or returned, the gift must also be returned unused and in its supplied condition. If the customer keeps the gift, we may deduct its clearly disclosed reasonable value from a discretionary refund, but never from a refund or remedy where such a deduction is prohibited by law.
10. Referral and loyalty offers
Referral credits and loyalty benefits may be subject to account verification, a qualifying purchase, a waiting period, expiry, and reasonable anti-fraud checks. Self-referrals, duplicate or fictitious accounts, unsolicited bulk messages, and misleading claims and referrals made without the recipient’s consent are prohibited.
Credits are promotional benefits, not deposits or electronic money, unless expressly stated otherwise. They are not transferable or redeemable for cash and may be removed where the qualifying transaction is lawfully cancelled, refunded, reversed, or found to be fraudulent.
11. Competitions, giveaways, and prize promotions
Each competition or giveaway will have specific rules stating the eligibility criteria, entry method, promotion period, prize, selection method, notification process, claim deadline, and any material restrictions.
No payment will be required to enter unless the promotion is lawfully structured and operated with every approval or license required under Ghanaian law. Where a promotion involves chance, gaming, a raffle, or a lottery, we may postpone, modify, or withdraw it to obtain regulatory approval or comply with directions from the competent Ghanaian authority.
Winners will be selected fairly using the stated method. We may verify eligibility before awarding a prize. A winner must not be required to pay an undisclosed fee to receive a genuine prize. If a winner does not respond within the disclosed claim period, is ineligible, or cannot be verified, we may select an alternative winner using the same stated method.
Prizes are non-transferable and have no cash alternative unless stated or required by law. Any personal data used to administer or publicize a promotion will be processed lawfully. A winner’s image, name, social media handle, or testimonial will be published only on an appropriate lawful basis and, where consent is relied on, within the scope of that consent.
12. Influencer, affiliate, and social media promotions
Paid, gifted, affiliate, or otherwise sponsored promotional content must be clearly identifiable as advertising or a commercial relationship. Influencers, affiliates, and partners must make honest statements, avoid unsubstantiated claims, and follow our instructions and applicable Ghanaian law.
A promotion hosted on Instagram, TikTok, Facebook, Snapchat, WhatsApp, or another platform is not sponsored, endorsed, or administered by that platform unless expressly stated. The platform’s own terms may also apply, but they do not replace these promotion terms or Ghanaian law.
13. Product descriptions and wig-related claims
Promotional images may show styling, lighting, color variation, or accessories. We will provide a sufficient and accurate description of the wig or service, including material, length, color, density, cap or lace features, and customization where relevant. Minor color differences caused by screens or lighting will not excuse a description that is materially misleading.
Results, longevity, and appearance depend on the product, installation, maintenance, heat, chemicals, storage, and individual use. Statements such as “glueless,” “human hair,” “donor hair,” “beginner friendly,” or a claimed length or density must be understood according to the description provided for the particular product. Nothing in a promotion guarantees a result that is not expressly stated.
We will not make false or unsubstantiated medical, therapeutic, or hair-growth claims.
14. Returns, exchanges, refunds, and cancellation
Buying an item on promotion does not by itself remove a customer’s rights under Ghanaian law. Eligible promotional items may be returned, exchanged, refunded, or cancelled in accordance with our Returns, Exchanges, and Refund Policy, Order Cancellation Policy, and the Electronic Transactions Act, 2008 (Act 772).
Any statutory cancellation, refund, or other remedy takes priority over a statement such as “sale items are final.” Lawful exceptions may apply to custom-made, personalized, altered, installed, worn, or hygiene-sensitive products where the nature of the goods and applicable law permit an exception. Those exceptions will be clearly communicated and will not apply to goods that are defective, misdescribed, or otherwise subject to a mandatory remedy.
Unless the law requires otherwise, a refund for a discounted item will not exceed the amount actually paid for that item. If a promotion code was apportioned across several products, the refund will reflect the discounted amount allocated to the returned product. Delivery charges are handled under our Returns, Exchanges, and Refund Policy and applicable law.
15. Payment reversals and failed transactions
A promotion is not successfully redeemed until payment and order validation are complete. Mobile-money, card, bank, or payment-provider delays may affect order confirmation but will not lawfully shorten a published promotion after the customer completes the required steps on time.
If payment is duplicated, reversed, or taken for an order we cannot fulfill, we will investigate and process any amount due through the original payment method or another method agreed with the customer. Payment services are also subject to the authorized provider’s terms and applicable Ghanaian payment law.
16. Fair use and prohibited conduct
Promotions are intended for genuine customers. A person must not:
- use false identities, multiple accounts, bots, or automated entries;
- tamper with the website, code, payment, or entry process;
- copy, sell, publish, or distribute a private or single-use code without permission;
- exploit an obvious technical malfunction in bad faith;
- make fraudulent orders, chargebacks, referrals, or returns;
- harass staff or other participants; or
- engage in unlawful, abusive, or deceptive conduct.
Where we have reasonable evidence of misuse, we may refuse an entry, suspend a benefit, or cancel an affected order after a fair review. We will not withhold a customer’s money without a lawful basis and will provide any refund required by law.
17. Changes, suspension, and cancellation of a promotion
We may change, suspend, or cancel a promotion where reasonably necessary because of fraud, illegality, regulatory direction, security incidents, system failure, stock failure, or events genuinely beyond our reasonable control. We will communicate a material change through the same or a reasonably equivalent channel used to advertise the offer.
We will not change an offer retrospectively merely to avoid honoring valid redemptions already accepted. Where a change materially disadvantages an eligible customer who has already acted in reliance on the published offer, we will provide a fair and lawful remedy.
18. Personal data and marketing
We may collect names, contact details, order information, account details, entries, photographs, or other information needed to administer a promotion, prevent fraud, deliver prizes, comply with law, and handle complaints. We will process personal data in accordance with the Data Protection Act, 2012 (Act 843), and our Privacy Policy.
Entry into a promotion does not automatically authorize unrelated direct marketing. Where consent is required, marketing consent will be requested separately and may be withdrawn. Every eligible recipient may object to or opt out of direct marketing in accordance with Ghanaian law.
We will not require more personal information than reasonably necessary for the promotion and will retain it only for the applicable purpose and lawful retention period. Information may be shared with service providers only where necessary and subject to appropriate safeguards.
19. Liability
Nothing in these Promotion Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, deliberate misconduct, or a mandatory consumer remedy.
Subject to the preceding sentence, we are not responsible for a participant’s failure to meet published conditions, inaccurate contact information, an interruption outside our reasonable control or an indirect loss that was not reasonably foreseeable when the promotion was entered. This clause does not excuse our failure to use a secure payment system or comply with duties imposed by Ghanaian law.
20. Complaints and dispute resolution
A customer should first contact us at info@thehairboutiquebyfelicity.com and provide:
- their full name and contact details;
- the promotion name or code;
- the order or transaction number;
- a description of the issue; and
- copies of relevant advertisements, screenshots, receipts, or messages.
We will acknowledge and investigate complaints within a reasonable time and communicate our decision in clear language. Where appropriate, the parties may attempt good-faith negotiation or a mutually agreed alternative dispute-resolution process before court proceedings.
Nothing in this section prevents a customer from contacting a competent Ghanaian regulator, law-enforcement body, or court or from exercising any non-excludable legal right.
21. General provisions
If any part of these Promotion Terms is found unlawful or unenforceable, the remaining parts will continue to apply to the extent permitted by law. A delay in enforcing a term is not a waiver of that term. Headings are for convenience only.
These Promotion Terms and the promotion-specific conditions constitute the applicable promotional agreement, together with the website policies incorporated by reference. Electronic records, notices, and acceptances may be used as permitted by the Electronic Transactions Act, 2008 (Act 772).
The courts of Ghana will have jurisdiction without preventing a customer from using another forum or remedy that Ghanaian law makes available.
22. Updates to these Terms
We may update these promotion terms to reflect legal, regulatory, operational, or service changes. The revised version will be posted with a new “Last updated” date. Unless law requires otherwise, a material change will apply prospectively and will not unfairly alter a promotion already accepted.
